Terms of Use for LEVEL5 ID

LEVEL5 Inc. (hereinafter “LEVEL5”) hereby establishes the following Terms of Use for LEVEL5 ID (hereinafter “these Terms”).

Article 1 — Definitions

The definitions of the major terminology used in these Terms shall be as follows.

  1. “Services” shall mean the service referred to as “LEVEL5 ID”, which is used by customers as membership information for the individual services provided by LEVEL5, including the major functions of membership authentication, data management, and information distribution for individual services.
  2. “Member” shall mean an individual customer who has become eligible for the Services according to the procedures set forth in these Terms.
  3. “Individual Services” shall mean individual game services, information services, and others provided by LEVEL5 and designated by LEVEL5 as subject to the provision of the Services.
  4. “Individual Terms” shall mean the terms of use, guidelines, various arrangements, and notices from LEVEL5 specific to Individual Services.
  5. “The Account” shall mean a unique account ID used to identify and manage Members in the Services.
  6. “The Site” shall mean the portal site for the Services, established on the server of LEVEL5 or that of a third party designated by LEVEL5.
  7. “LEVEL5 ID Points” are points awarded to Members in proportion to their purchase of paid content within Individual Services linked to the Account, as determined separately by LEVEL5 on the Site.
  8. “Status” means the rank based on the number of LEVEL5 ID Points.

Article 2 — Scope of these Terms

  1. These Terms apply to all Services, and Members shall be bound by and must strictly adhere to these Terms.
  2. In addition to these Terms, the various arrangements and precautions for using the Service that are separately stipulated by LEVEL5 shall also constitute a part of these Terms.
  3. Members who use Individual Services must agree to and abide by the Individual Terms as well as these Terms.

Article 3 — Changes to These Terms

  1. LEVEL5 reserves the right to change these Terms at any time.
  2. Any changes to these Terms shall become effective after a period separately determined by LEVEL5, starting from the date the revised Terms are posted on the Site or from the date of notification to the email address registered by Members for using the Services.
  3. LEVEL5 shall not be liable for any disadvantages or damages incurred by Members as a result of changes to these Terms.

Article 4 — Registration

  1. Persons desiring to use the Services must accept these Terms and apply to use the Services in accordance with the procedures specified by LEVEL5. A contract for use of the Services shall be established between the applicant and LEVEL5 when LEVEL5 accepts the application and grants an Account to the applicant.
  2. If the customer is under the age of 18 (or the legal age of majority in your country of residence) or have limited mental capacity, the customer shall obtain consent from a legal representative such as a parent or guardian respecting these Terms before applying for use of the Services in accordance with the preceding paragraph.
  3. Members shall keep information related to this Account strictly confidential and shall not reveal it to any third party.
  4. If a Member wishes to change their Account information, LEVEL5 may require the Member to present identifying documents prescribed by LEVEL5, including official documents.

Article 5 — Disapproval or Cancellation of Membership Registration

If LEVEL5 determines that any of the following applies or is likely to apply, LEVEL5 may not approve a registration for the Services. In addition, even after approval, LEVEL5 may cancel any registration for the Services if LEVEL5 determines that the applicant falls under any of the following or is likely to fall under any of the following.

  1. When the application for use of the Services includes false information
  2. If the application to use the Services is made by an impersonator
  3. If the use of these Services or Individual Services by the applicant has been suspended or cancelled
  4. In any other cases where it is deemed inappropriate to make the applicant a Member

Article 6 — Prohibitions

  1. Members shall not engage in any of the following acts when using the Services.
    1. Violations of these Terms
    2. Unauthorized use of a third party’s Account
    3. Impersonating a third party (including a fictitious third party) by registering or providing false information
    4. Use of a single Account by more than one person
    5. Criminal acts, criminal instruction, or criminal incitement
    6. Posting personal information or information that can identify an individual, or collecting the personal information of third parties
    7. Stalking or stalking-like behavior
    8. Defaming or damaging the credibility of LEVEL5, other Members, or third parties
    9. Acts that are offensive to other Members, such as nuisance, slander, harassment, obscenity, or others
    10. Obscene, discriminatory, or violent expressions, as well as acts offensive to public order and morals
    11. Infringing the patent rights, utility model rights, design rights, trademark rights, copyrights, technical or business know-how, or other rights of LEVEL5 or any third party, or any license or other right based on such rights
    12. Actions that place an excessive load on LEVEL5's servers
    13. Use or provision of unauthorized tools or programs not intended by LEVEL5
    14. Unauthorized access to LEVEL5’s or a third party’s systems, for the modification, alteration, analysis, reverse engineering, or others of the Services or Individual Service programs
    15. Use of the Services by using unauthorized tools or applications that are not intended by LEVEL5
    16. The trading of Accounts, LEVEL5 ID Points, virtual currency, in-game currency, in-game characters, or others acquired within the Services or Individual Services for real currency, electronic money, or others
    17. Intentional exploitation of defects in the Services
    18. Interfering with the smooth operation of LEVEL5 by making unreasonable inquiries or demands beyond the legal responsibility of LEVEL5 or LEVEL5’s customer support
    19. Acts which assist, encourage, or prepare for any of the preceding items
    20. Other activities deemed inappropriate by LEVEL5
  2. If a Member falls under any of the prohibited items in the preceding paragraph, LEVEL5 may take any or all the following measures.
    1. Caution or warning
    2. Restrictions on use of the Services and Individual Services, including the suspension of use
    3. Deletion of the Account and restriction on re-registration as a Member

Article 7 — Principle of Self-Responsibility

  1. Members shall use the Services at their own risk.
  2. If a Member causes damage to LEVEL5 as a result of using the Services, the Member shall be obliged to compensate LEVEL5 for such damage at their own responsibility and expense.
  3. Members shall bear the cost of the preparation and maintenance of equipment, software, means of communication, and others necessary to use the Services.
  4. Members should always check for announcements from LEVEL5, either on the Site or in emails sent to their registered email address. LEVEL5 shall not be liable for any disadvantage or damage incurred by a Member as a result of the Member’s failure to confirm the contents of such announcements.
  5. Members shall be responsible for resolving any disputes between themselves and other Members or third parties at their own expense and responsibility.
  6. Members shall be responsible for the management of information related to their Accounts and are liable for any damage caused from the use of their Accounts by third parties, regardless of the reason. Even in the case of unauthorized use by a third party, LEVEL5 may deem the Member to have used the Account themselves.

Article 8 — Outsourcing of Operations

LEVEL5 may outsource all or part of the operations related to the Services to a third party without the consent of Members.

Article 9 — Change or Suspension of Services

  1. LEVEL5 may change the content of the Services without prior notice to Members.
  2. In the event of any of the following, LEVEL5 may temporarily suspend all or part of the Services without prior notice to Members.
    1. When performing maintenance or updating of the operating equipment of the Services
    2. In the event of an accident or natural disaster such as fire, power outage, or others
    3. When the provision of the Services becomes impossible due to laws, regulations, or others
    4. Other cases as deemed necessary by LEVEL5
  3. LEVEL5 shall not be liable for any disadvantage, damage or loss incurred by Members as a result of actions taken in accordance with this Article.

Article 10 — Cancellation of Member Registration

  1. If a Member wishes to cancel their membership in the Services, they must follow the procedures prescribed by LEVEL5.
  2. The Status of the Services and LEVEL5 ID Points held shall expire upon completion of the membership cancellation procedure.
  3. If a Member has linked Individual Services to their Account, that link will be cancelled upon completion of the membership cancellation procedure.
  4. LEVEL5 shall not be liable for any disadvantage or damage incurred by Members as a result of the cancellation of their membership in the Services.

Article 11 — Disclaimer

  1. LEVEL5 does not guarantee the completeness, usefulness, accuracy, reliability, safety, or fitness for Members’ purposes of the content of the Services or Individual Services.
  2. LEVEL5 shall not be liable for any loss or damage incurred by a Member as a result of the use of the Services or Individual Services except in the case of the willful or negligent fault of LEVEL5, and LEVEL5 shall be exempted from any obligation to compensate a Member for such losses or damage.
  3. Notwithstanding the provisions of the preceding paragraph, LEVEL5 shall be liable to Members for damages, if a Member suffers any of the damage described in the preceding paragraph due to the willful misconduct or negligence of LEVEL5. However, the liability of LEVEL5 shall be limited to direct and ordinary damages actually incurred by a Member regardless of the cause of the claim.
  4. LEVEL5 is not involved in, and assumes no responsibility for, disputes between Members and third parties. Members shall resolve such disputes at their own risk and expense.
  5. LEVEL5 shall not be liable for any violation of the laws and regulations of Japan or any other country arising from the use of the Services or Individual Services by Members.

Article 12 — Prohibition of Transfer

Members shall not share their Account with any third party, and shall not transfer, lend, or confer this Account to any third party, with or without compensation.

Article 13 — Handling of Personal Information

LEVEL5 shall handle the personal information of Members obtained through the Services appropriately in accordance with LEVEL5’s separate “Privacy Policy.

Article 14 — Severability

If any provision of these Terms is held invalid by law or regulation, all other provisions of these Terms aside from the invalidated provisions shall remain in effect.

Article 15 — Governing Law and Jurisdiction

  1. These Terms shall be governed by and interpreted in accordance with the laws of Japan.
  2. The Fukuoka District Court shall be the exclusive court of first instance for any disputes between LEVEL5 and Members related to the Services, Individual Services, and these Terms.
  3. The Japanese version of these Terms shall be the official version. In the event of any discrepancy between the Japanese version of these Terms and any other language version, the Japanese version shall prevail.
